Broome Community College is governed by a ten member Board of Trustees. Five of the trustees are appointed by the County Executive, with the approval of the
County Legislature; four by the Governor; one member is a Broome Community College student (with voting privileges), elected by student peers.
The College President is appointed by Broome Community College's Board of Trustees, with the approval of the SUNY Chancellor and SUNY Board of Trustees.
The President is the chief executive officer who reports directly to the Chairperson
of the College Board of Trustees and whose governing authority is stipulated in
section 604.3 (Responsibilities and Duties of the Presidency) of Codes, Rules, and
Regulations of the State of New York, Title 8 Education, Vol. B.
Rapport is maintained with the Sponsor through the County Executive or the
Deputy County Executive and Committee Chairpersons/Members of the Broome
County Legislature.
Three key governance units advise the President: the President's Executive
Council, College Council and the Student Government Association.
Informal communications are maintained between the President and the executive
officers of the bargaining units (3): Faculty Association (FA), Guild and BCC
ESPA.

Purchases and contracts $100,000 and above:
Upon recommendation of the Finance and Facilities Committee the Board of
Trustees shall approve any purchases or shall award any contracts greater than or
equal to $100,000 including purchases on New York State Contract.

The Board of Trustees authorizes the Treasurer of the College to establish and
maintain petty cash funds, not in excess of two hundred ($200.00) dollars each in
accordance with Local Law
No. 8, 1990 legislation.
The Treasurer of the College shall present lists of all expenditures made from
such petty cash funds to the Finance and Facilities Committee of the Board of
Trustees at each regular meeting thereof, together with the bills supporting such
expenditures.
The Finance and Facilities Committee of the Board, upon recommendation of the
Treasurer, shall direct reimbursement of such petty cash funds from the
appropriate budgetary item or items in an amount equal to the total of such bills
which the Committee shall so audit and allow.
The Treasurer shall have the authority to direct reimbursements of such petty
cash funds during the periods between regular meetings of the Finance and
Facilities Committee of the Board of Trustees.

The Finance and Facilities Committee of the BCC Board of Trustees shall approve
budget transfers that are greater than or equal to $50,000 or cumulative budget
transfers in equipment, supply, expense and travel that are greater than 5% of
divisional appropriations (Administration, Academic, Student Affairs), and total at
least $50,000.
Upon recommendation of the Finance and Facilities Committee, the Board of
Trustees shall approve cumulative budget transfers of personnel and fringe
benefits that are greater than 5% of divisional appropriations. Such transfers
shall require the additional approval of the Broome County Legislature.
The President shall establish procedures necessary to effect transfers below these
levels.
Definition of a Budget Transfer
A Budget Transfer is a reallocation of appropriations between divisions (Academic,
Administration, and Student Affairs), or within a division between characters of
expense (Personnel, Fringe, Contractual Expenses, and Equipment). This
definition reflects the budget detail adopted by the Broome County Legislature
and the BCC Board of Trustees.
Examples:
1. Chemical Tech supplies to Chemical Tech equipment
2. VPAFA personnel to VPAA personnel
3. VPAFA personnel to VPAFA supplies
4. VPAFA equipment to VPAA equipment
Reallocation of appropriations within a division and within a character are not
Budget Transfers. The President shall establish procedures necessary to ensure
adequate internal control over these reallocations.

1. All teaching faculty members at the rank of Assistant Professor and above
(or the equivalent re: counselors and librarians) shall have the minimum of
a Master's Degree in their related field at the time of employment. Specific
requirements are stated in the respective position descriptions.
2. In cases where individuals are employed without a Master's Degree, at the
rank of Instructor (or the equivalent re: counselors and librarians) will be
given four years to secure an approved Master's Degree.
3. Individuals employed without a Master's Degree will receive annual credit
toward "Continuing Appointment" based on the College's evaluation process
and approval of the President but will not have this status granted until the
Master's Degree is completed.
4. Such individuals who are employed at the Instructor level must also file
with the Vice President for Academic Affairs an educational plan specifying
the particular Master's Degree the individual will be pursuing as well as a
specific four-year time plan for its completion. The "plan" will be updated
on an annual basis and subsequent appointment will be reviewed against
this plan.
5. Failure to receive the Master's Degree within the allotted time (four years)
will constitute termination, accordingly.
6. Faculty hired at the Instructor level, who subsequently complete an
approved Master's Degree, are eligible for promotion according to the
current guidelines governing this process.

In keeping with our position of public trust it is essential that all members of the
college community avoid any and all circumstances which could reasonably be
interpreted as conflict of interest. Such circumstances are those which would
interfere with the unbiased and objective performance of one's professional duties.
Any employee or trustee of the college having an actual or potential conflict shall
be responsible for announcing that conflict in order that appropriate action may
occur. Further, all employees and trustees of the college community shall accept
responsibility for investigating and conscientiously dealing with actual or potential
conflicts of interest of which they have knowledge.

o The President shall accept all grants below $50,000, and they shall be
reported to the BCC Board of Trustees on a monthly basis.

possession in certain acceptable investment instruments as outlined in the procedures
for college investments. In investing such funds, the Treasurer shall concurrently
pursue the following objectives:
1. To provide a level of liquidity sufficient to insure the availability of funds for
payment to meet obligations of the College or for disbursement otherwise
required.
2. To minimize the amount of funds uninvested.
3. To minimize the risk of any potential loss or devaluation of funds invested.
4. To earn a maximum rate of return on funds invested.

1. The Board of Trustees of Broome Community College, through the
establishment of this policy, intends to follow the Copyright Law of the United
States currently in force under Title 17 of the United States Code. The Board
of Trustees further requires all College employees to adhere to the same
copyright law.
2. Any reproduction of copyrighted material, by College employees, for use in the
course of their duties will be done in compliance with the Copyright Law. All
reproduction of copyrighted material will either meet the criteria of fair use
guidelines, or have a license agreement or the written permission of the
copyright holder to make copies.
3. If the College/County determine that a charge of copyright infringement
against an employee was not an intentional violation of the law, the
College/County (as outlined in Section 18 of the Public Officers Law and
Section 6308 of the Education Law) will defend and indemnify the charged
employee. In the case of a court action for damages, a finding of intentional
infringement would preclude the College paying any judgment rendered
against the employee.

Records Retention and Disposition Schedule CO-2, issued by the NYS
Archives and Records Administration, and pursuant to Article 57-A of the Arts
and Cultural Affairs Law, and containing legal minimum retention periods for
public community college records, shall be used by all college officers in disposing
of public community college records listed therein.
In accordance with Article 57-A:
(a) only those records will be disposed of that are described in Records
Retention and Disposition Schedule CO-2 after they have met the minimum
retention period prescribed therein;
(b) only those records will be disposed of that do not have sufficient
administrative, fiscal, legal, or historical value to merit retention beyond
established time periods.

organizations.

The Board of Trustees authorizes the College President to develop a list of
college spaces and locations which may be named in recognition of an individual or
a group who has made a significant financial contribution to the College.
The Trustees will approve general "suggested levels of support" for various
locations before the College or BCC Foundation offer to name a site in someone's
honor. Once a donor has been identified with a particular location, a
recommendation will be forwarded for approval by the Board of Trustees.

Members of the college community, regardless of gender or sexual orientation, are
prohibited from being romantically or sexually involved with a person over whom they are in a position
of direct, indirect, or implied power. Additionally, members of the college community, regardless of
gender or sexual orientation, are prohibited from being in a position of direct, indirect, or implied
power over someone with whom they are romantically or sexually involved. This includes, but is not limited
to, persons whom one teaches, advises, coaches, counsels, mentors, evaluates, or supervises in any way.
Individuals in positions of authority must avoid making sexual overtures to students
or employees whom they supervise or over whom they have another form of power.
If a student or subordinate employee makes such overtures to a BCC employee who is in a position
of power over the student or employee, the employee in the position of power must not allow a
romantic relationship to develop.
Exemptions to this policy may be granted if full severance of the college relationship
would create undue academic or financial hardship for the student or subordinate
employee. However, if an exemption is granted, supervisory duties must be assigned to
another employee to the extent possible.
